Goons — Terms and Conditions

Acceptance of Terms

By accessing or using the Goons application (the "App"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of the Terms, you may not access the App.

Age Requirement

You must be at least 13 years old to use the App. Goons is recommended for players aged 14 and above due to the game's voting and elimination mechanics. Players between 13-17 years old should have parental or guardian supervision.

Description of the App

Goons is a pass-the-phone party game for 5-16 players. The App facilitates role assignment, night actions, day voting, and game management. The App is designed for offline play using a single device passed around a table, or via local Wi-Fi for multi-player modes where each participant uses their own device.

2.3 Intellectual Property

2.3.1 App Content

All content included in the App, such as but not limited to text, graphics, logos, images, audio clips, digital downloads, data compilations, and software, is the original property of Phinetech Goons or its content suppliers and is protected by international copyright laws.

2.3.2 User-Generated Content

Player names and any custom role descriptions you create are your property. However, by using the App, you grant Phinetech Goons a non-exclusive, royalty-free license to use, display, and store your user-generated content for the purpose of providing the App's functionality.

2.3.3 Third-Party Content

The App may contain links to third-party websites or services that are not owned or controlled by Phinetech Goons. Phinetech Goons has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party sites or services.

3. User Conduct

When using the App, you agree not to:

• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App
• Modify, adapt, translate, or create derivative works based on the App
• Use the App for any illegal purpose or in violation of any local, state, national, or international law
• Transmit any material that contains software viruses, worms, Trojan horses, or any other code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware
• Interfere with or disrupt the security of the App, including related systems or networks, or violate the policies, procedures, or regulations of any networks
• Harass or discriminate against other players based on age, race, gender, religion, or any other characteristic
• Attempt to gain unauthorized access to any portion of the App or related systems

3.1 Multi-Player Conduct

When using the Multi-Phone mode, you agree to:

• Host responsibly: If you create a room, you are responsible for maintaining an appropriate playing environment
• Respect fellow players: Treat all participants with respect and follow good sportsmanship
• Room integrity: Do not share room codes with unauthorized individuals or attempt to disrupt other people's games
• Data privacy: Do not collect or share other players' personal information (names, roles, etc.) outside the game context

4. Privacy

Your privacy is governed by our Privacy Policy, which forms part of these Terms. Please review our Privacy Policy located at /privacy.html, which describes what data the App collects and how it is used.

5. Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE" without any warranties of any kind, either express or implied. To the maximum extent permitted by applicable law, Phinetech Goons disclaims all warranties, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Phinetech Goons does not warrant that:

• The App will meet your requirements
• The App will be uninterrupted, timely, secure, or error-free
• The results obtained from using the App will be accurate or reliable
• The quality of any products, services, information, or other material purchased or obtained through the App will meet your expectations
• Any errors in the App will be corrected

6. Limitation of Liability

To the maximum extent permitted by applicable law, Phinetech Goons, its directors, employees, affiliates, agents, partners, or licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, or other intangible losses, resulting from:

• Your access to or use of the App
• Your inability to access or use the App
• Any conduct or content of any third party on the App
• Any content obtained from the App
• Unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other theory of liability, whether or not it was reasonably foreseeable that such damage would occur

Some jurisdictions do not allow the exclusion of implied warranties or the limitation of liability for consequential or incidental damages, so some of the above limitations may not apply to you.

7. Indemnification

You agree to indemnify, defend, and hold harmless Phinetech Goons and its directors, employees, affiliates, agents, partners, and licensors from and against any and all claims, losses, liabilities, damages, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:

• Your access to or use of the App
• Your content or information transmitted or displayed via the App
• Your violation of these Terms
• Your violation of any rights of another person or entity

7. Termination

Phinetech Goons may terminate your right to use the App at any time, without prior notice, for any reason or no reason at all. Upon termination, you must immediately cease all use of the App. The provisions of these Terms that by their nature should survive termination will survive, including, without limitation, ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where Phinetech Goons operates, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located within that jurisdiction.

9. Complete Agreement

These Terms constitute the entire agreement between you and Phinetech Goons regarding your use of the App, and supersede all prior and contemporaneous agreements, representations, and understandings, whether written or oral, regarding such subject matter. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
